1. Definitions & Terminology
“Rules” refers to the code of conduct and conditions of the same name, specified by the Event Organiser in relation to the Event.
"Conditions" means these terms and conditions of and for the Event.
"Booking" means the on-line booking system which must be completed through the event website in order to participate in the Event.
"Event" means the event named on the Booking system (Eroica Britannia). The ‘Event’ begins on your arrival to the Event and departure of the Event.
"Event Organiser" means Eroica Britannia and its appointed staff and / or agents. The trading entity behind Eroica Britannia is Britannia Ahoy Ltd (the Event Organiser and Promoter).
"Fee" means the entry fee for the Event as set out in the Booking system.
“Ticket” means any valid ticket or wristband which permits you to attend the Event or any valid wristband for which you have exchanged your valid ticket for at the Event.
"Participant" means the person named on the Entry Form who will be participating in the Event.
“Parties” means the Promoter and the Participant and each shall be a “Party”.
2. Acceptance of Conditions
2.1 These Conditions shall apply in place of and prevail over any terms or conditions (whether or not in conflict or inconsistent with these Conditions) contained or referred to in any documentation submitted by the Participant or in correspondence or elsewhere or implied by trade custom, practice or course of dealing. A variation of these Conditions is only valid if the Event Organiser gives notice to the Participant in writing in any official Event material or correspondence prior to the Event (including via email). The Participant shall be deemed to have accepted these Conditions upon completion of a Booking.
2.2 All Tickets are sold subject to these Conditions. Please read these Conditions carefully prior to purchase and raise any queries with the Event Organiser prior to purchase. Purchase of any Ticket constitutes acceptance of these Conditions on your behalf and on behalf of any person for whom you are purchasing Tickets.
2.3 These Conditions form the basis of your contract with Britannia Ahoy Ltd, trading as Eroica Britannia. In these conditions ‘you’ and ‘your’ are references to the party leader who must book on behalf of all persons named on the booking. “Written” or “in writing” refers to any correspondence, either by email or by posted letter, between you and Britannia Ahoy Ltd or by notification on the relevant Britannia Ahoy Ltd website i.e. www.eroicabritannia.co.uk. On completion of Booking you hereby agree to these terms and conditions, the party leader confirms that he/she is so authorised and that all party members agreed to be bound by these conditions. References to ‘we’, ‘our’, and ‘us’ are references to Britannia Ahoy Ltd. The contract between us is governed by English Law and any dispute will be dealt with under the exclusive jurisdiction of the English Courts. Our contract with you is deemed to be made at the offices of Britannia Ahoy Ltd, 33 Chelsea Road, Sheffield, S11 9BQ.
3.1 The Participant is aware of the nature of the Event and the associated risks involved and agrees that he/she is physically capable of participating in the Event and is to be solely responsible for his/her actions and the Event Organiser, its officers, employees, agents, affiliates, associated companies, sponsors or medical advisers are not responsible for any injury or illness that the Participant may suffer as a result of his/her participation in the Event. The Participant accepts that should any medical or physical condition arise prior to the Event which is likely to affect his/her ability to participate, the Participant will withdraw from the Event in accordance with these Conditions.
3.2 The Participant agrees to abide by all applicable rules and regulations including any Rules and any relevant regulations as published by the Event Organiser. The Participant shall not be entitled to a refund of the Fees if he or she is disqualified from the Event as a result of an infringement of these Conditions and/or Rules.
3.3 The Participant must complete the ticket purchasing registration process online via the event website (www.eroicabritannia.co.uk).
3.4 It shall be the Participant’s sole responsibility to provide safety equipment and / or personal protective clothing which shall be in a good condition in order to comply with the Rules. Participants must take particular note of the regulations relating to helmets as laid out in the Rules.
3.5 The Event Organiser reserves the right at any time to remove Participants from the Event or prevent Participants participating in the Event if it considers such action necessary for safety reasons or to ensure the proper enjoyment of the Event by other Participants or for any other reasonable reason. No refund of the Fee shall be made if the Participant has acted negligently, maliciously, with wilful misconduct or otherwise without due care and attention for the Event or other Participants so as to cause his or her removal.
3.6 The Event Organiser reserves the right to impose sanctions as identified in the Rules which may include disqualification from the Event.
3.7 While the Event Organiser takes every care with the staging of the Event, the Participant acknowledges that personal accident and personal items insurance is his or her sole responsibility.
3.8 The Participant is required to complete all age related information required on the Booking system and shall ensure that all age limitations are complied with according to the Ride Day Rules.
3.9 All decisions and rulings by the Event Organiser, its employees and its agents are considered final. Accordingly, the Participant will comply with all Event rules and all instructions and guidelines given by stewards, marshals, and safety personnel. The Participant acknowledges and agrees that the Event Organiser will organise and run the Event and will have sole authority and be the final arbiter on all decisions relating to the safety, running and organisation of the Event, the rules of the Event, the timings/finish times and the overall positions.
3.10 These Conditions are personal to the Participant and the Participant may not assign any of its rights or obligations under these Conditions without the prior written consent of the Event Organiser. The Participant represents and warrants that the entry to the Event is personal to the Participant and entry into the Event is not purchased as part of any form of business or commercial activity (save as expressly authorised by the Event Organiser), and in particular, may not be resold or offered for resale whether at a premium or otherwise and may not be used for advertising, used as a prize (including in competitions and sweepstakes) unless with prior arrangement with the Event Organiser, travel packages, or for any other trade purposes. Unauthorised resale or attempted resale is grounds for seizure or cancellation of the Participant’s entry into the Event without a refund or other compensation.
3.11 The Participant acknowledges and accepts that circumstances concerning an Event may change from time to time for reasons beyond the Event Organiser’s reasonable control or otherwise, without the Event Organiser incurring any liability and without any rights to withdrawal being accrued by the Participant other than set out in Condition 4 below. The Event Organiser shall use reasonable means to communicate any changes to the Participant as soon as reasonably practicable.
3.12 If riders need to use a mobile phone during the event they must dismount from their bicycle. The Event Organiser will not be liable for any incidents that may occur due to mobile use whilst the Participant is riding.
3.14 Use of headphones during the cycle ride Event itself is not permitted at any time.
3.15 By entering the Event all Participants confirm that they have read, understood and will adhere to the Articles contained in the Rules pertaining to the type, age and characteristics of bicycles.
3.16 Children aged 12 years or under are allowed in free to the festival element of the Event subject to them being booked via the Booking system by a parent or guardian. However, proof of identity and age must be provided on request at the admissions gate to the Event. The Event Organiser reserves the right to refuse admission if its staff or agents are in any doubt whatsoever as to the age of the person being presented as being 12 years or younger. All children under 12 years need to be registered online and allocated the applicable wristband on arrival; for licensing purposes all children need a Ticket for the Event and wristbands will be issued on arrival of the Event. Wristbands need to be put onto the child directly by our staff. You cannot collect wristband on their on anyone’s behalf.
4. Bookings & Payments
4.1 The Participant must pay the Fee when they enter using the Booking system before the Event as specified by the Event Organiser. Fees for Events are subject to periodic review by the Event Organiser.
4.2 The Participant shall not be eligible or entitled to participate in the Event until full payment of the Fee has been received by the Event Organiser. No payment shall be deemed to have been received by the Event Organiser until cleared funds are confirmed.
4.3 The Event Organiser reserves the right at its sole discretion and in extenuating circumstances to accept Entry Forms and Fees after the closing date specified by the Event Organiser and to modify the process for entry to the Event.
4.4 The Participant may assign his/her Ride entry to another person up until May 31st 2018, at which point no tickets are permanently assigned. Infringement of this Condition compromises the integrity of the Event and will result in disqualification of the Participant and the person to whom his or her entry was assigned from the Event and future events.
4.5 Participants shall notify the Event Organiser of contact details including their emergency contact details in the Booking system. Participants shall make any subsequent amendments to their emergency contact details via their online account.
4.6 Verbal descriptions and telephone conversations are subject to interpretation and cannot be proven or confirmed. We accept no liability for this. Website bookings are also subject to technical error. Therefore all telephone and website bookings and quotes are subject to our written confirmation and this is why it is important that you check your booking confirmation as soon as you receive it via email. Errors in costings are very rare. However, if there is an obvious error on your booking confirmation we reserve the right to correct this as soon as we are aware of it.
4.7 Ticket purchase may be limited to a maximum number permitted per person, per card or per household. We may cancel tickets purchased in breach of any such limit without prior notice, in which case you will be refunded the ticket price and any booking, transaction or other supplementary fees you may have paid. This is at the discretion of Britannia Ahoy Ltd.
4.8 Tickets will be by electronic download via an online customer portal, accessible using your customer login via the Booking system. Access to this portal will be communicated to you via email prior to the Event date.
4.9 It is your responsibility to ensure that your correct email address is used at the time of booking. If not you will be unable to access your tickets online for download.
4.10 WAPPA Ltd t/a Ticket Tannoy is the authorised payment merchant of Britannia Ahoy Ltd. Upon paying your Fee the funds will be deducted from your credit / debit card by WAPPA Ltd t/a Ticket Tannoy at the time your credit / debit card is processed.
4.11 Britannia Ahoy Ltd has no access to payment card details.
5. Entry to / Attending the Event
5.1 The Event Organiser accepts no responsibility for your personal property. Lost & Found is located at the information point within Eroica Britannia Head Quarters on the festival site.
5.2 There will be no admission to the Event, or wristbands issued before the designated opening times on any day of the Event. At the discretion of the Event Organiser Wristbands may not be collected on behalf of other ticket holders.
5.3 Tickets are valid for the dates of the event only. You cannot enter on any other day / date. Tickets are for entry dependant on the ticket type purchased only and can be scanned / redeemed only once.
5.4 Entry will not be granted without a genuine and valid Ticket. Tickets are barcoded and each barcode is unique and allows entry dependant on the ticket type purchased only to the Event.
5.5 Valid Tickets are exchanged for wristbands on entry. Wristbands cannot be issued until the day / date as stated on the Ticket and are only issued directly to the Ticket holder on production of the Ticket. It is not possible to collect wristbands on behalf of other people, unless at the discretion of the Event Organiser.
5.6 Your ticket or wristband will be invalidated if any part of it is removed, detached, altered or defaced. Wristbands will not be reissued or replaced regardless of whether you still have your Ticket, unless at the discretion of the Event Organiser.
5.7 Those without wristbands will be refused admission to the site or be removed from the site. In all cases refunds will not be issued.
5.8 You may only leave and then re-enter the site if you have a valid wristband and is at all times at the discretion of the Event Organiser..
5.9 Admission to an Event is at all times subject to any terms, conditions or rules of the Event Organiser, venue or any of its sub-contractors, including as to time of admission, standards of behaviour and health and safety. If you breach these terms, conditions or rules then the Event Organiser may refuse admission or require you and other associated ticket holders to leave site. A ticket only guarantees you entry if you comply with the regulations at the Event including as to time of admission, standards of behaviour and health and safety.
5.10 The Event Organiser reserves the right to refuse you entry to and/or eject you from the Event without refund. In particular but without limitation you may be refused admission to or removed from the Event for any reason which may include but are not limited to: for health and safety or licensing reasons; if you behave in a manner which has or is likely to affect the enjoyment of other persons at the Event; if you use threatening, abusive or insulting words or mannerisms; if, in the Event Organiser’s reasonable opinion, you are acting under the influence of alcohol or drugs; if you demonstrate any form of anti-social behaviour; if you fail, when required, to produce proof of identity or age; if you refuse to comply with the Event Organiser’s security searches; if you carry offensive weapons or illegal or prohibited items or substances if you breach these Conditions; and/or if your Ticket is void. You will not be permitted to return to the festival site or purchase further tickets.
5.11 No under 18’s will be permitted entry to the festival without an accompanying adult aged 25 or over. There is a maximum of 4 under 18's per 1 person that is aged 25 & over.
5.12 Tickets for the Classic Ride and Nova Ride entitles the participant 3 day Festival access free of charge. This access right pertains only to the entered Rider and is non transferable to another person.
6. Search and Confiscation
6.1 The Event Organiser reserves the right to conduct security searches (including all vehicles) and confiscate any item which in the opinion of the Event Organiser may cause danger or disruption, be a health and safety risk, or not be suitable to be taken into the Event.
6.2 Anyone found in possession of illegal substances or contraband goods will be refused admission to or ejected from the Venue and may also be liable for prosecution. Any items found that may be used in an illegal or offensive manner will be confiscated, regardless of whether or not the item itself is illegal.
6.3 You shall not bring all or any of the following on to the site; alcoholic spirits, fireworks, laser pens, laser equipment, animals (with the exception of dogs), or any item which the Event Organiser considers could be used as a weapon (including sharp or pointed objects such as knives), items with an open flame (see camping section for further details) and illegal substances.
7. Special Requests and Specific Requirements for Access
7.1 The Event Organiser takes the needs of customers who are disabled or who have other access requirements very seriously and actively encourages people of all abilities to attend the Event.
7.2 If you have access requirements for Eroica Britannia please register your requirements through firstname.lastname@example.org.
7.3 If you have not notified the Event Organiser of your access requirements in advance we cannot guarantee that we will be able to cater to your needs, though we will use reasonable endeavours to do so.
7.4 Please note that special requests do not form part of our contractual agreement and we will have no liability if they are not met.
7.5 If you or any member of your party has any medical problem or disability which may affect the your attendance at the event, please tell us before you confirm the booking so we can advise as to the suitability. You must give us full details in writing at the time of the booking. If we feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline/cancel/amend the booking.
8.1 Camping at Eroica Britannia is only permitted provided you purchase a valid camping Ticket.
8.2 You must state if you will be camping at the time of Booking, this is to enable us to provide adequate facilities and avoid disappointment or overcrowding of campsites.
8.3 Campers should pitch tents in designated camping areas only and stay out of working areas. Pitched tents must not exceed a maximum footprint of 4 metres x 4 metres. If your tent exceeds 4 metres x 4 metres you must purchase more the correct quantity of tent camping ticket based on the overall footprint of your tent.
8.4 Gazebos, awnings or trailer tents are not allowed on the tent campsite.
8.5 You should bring a tent that is sized for the amount of occupants. We reserve the right to refuse to allow any structures which are too large or which we believe may cause a health and safety risk. Pitched tents must not exceed a maximum footprint of 4 metres x 4 metres per tent camping ticket purchase. If your tent exceeds 4 metres x 4 metres you must purchase more the correct quantity of tent camping ticket based on the overall footprint of your tent.
8.6 We will not be liable for any failure to provide any advertised facilities within the camping area.
8.7 All items brought to a campsite are brought and left at your own risk.
8.8 For safety reasons, we will not permit any gas canisters, nitrous oxide, cylinders or petrol cookers or aerosols over 250ml into the campsites, or anywhere on site. You cannot cook anywhere on site other than within the campsite. Items which may be used to cook within the campsite are subject to licence which may change on an annual basis. If unsure please check with the Event Organiser before bringing any cooking equipment onsite or using any such cooking equipment.
8.9 You are permitted to bring your own food and soft drinks for your own consumption in the campsites but not for resale. No glass is permitted on site. In addition, you are only permitted to bring either 12 x 300ml cans of beer/lager and/or cider per person OR 6 x 300ml cans of beer/lager and/or cider per person and 1 75cl bottle of wine (which must be decanted into a plastic bottle) per person. Such items may only be brought into the site on first entry. ALCOHOLIC SPIRITS ARE STRICTLY PROHIBITED. GLASS BOTTLES ARE STRICTLY PROHIBITED. Searches may be undertaken upon entry and re-admittance to ensure compliance with the provisions of these Conditions. Any alcohol above the permitted allowance may be confiscated.
8.10 Motor vehicles are not permitted on the tent campsite.
9. Motorhomes, Campervans, Caravans & Trailer Tents
9.1 All standard camping terms and conditions are applicable in addition to the specific terms outlined in this section.
9.2 Entry to the Motorhome, Campervan, Caravan & Trailer Tent field is only possible with the advance purchase of an applicable Ticket.
9.3 Motorhome, Campervan, Caravan & Trailer Tent tickets are available in advance only for site planning purposes.
9.4 As with all tickets, Motorhome, Campervan, Caravan & Trailer Tent tickets are non-transferable and non-refundable.
9.5 The Event Organiser reserves the right to search all vehicles upon entry.
9.6 Motorhome, Campervan, Caravan & Trailer Tent ticket holders in the Motorhome, Campervan, Caravan & Trailer Tent field only will be permitted to bring in gas containers up to the limit of 13kg.
9.7 Room for Motorhome, Campervan, Caravan & Trailer Tent are limited at the festival. It is your responsibility to ensure all vehicles and tents fit into your allocated area or risk removal from site, in which case refunds will not be issued.
9.8 Please note the ground at the Event can be quite uneven, so due care must be taken during ingress, set-up and egress.
9.9 You are permitted to bring your own food and soft drinks for your own consumption in the campsites but not for resale. No glass is permitted on site. In addition, you are only permitted to bring either 12 x 300ml cans of beer/lager and/or cider per person OR 6 x 300ml cans of beer/lager and/or cider per person and 1 75cl bottle of wine (which must be decanted into a plastic bottle) per person. Such items may only be brought into the site on first entry. ALCOHOLIC SPIRITS ARE STRICTLY PROHIBITED. GLASS BOTTLES ARE STRICTLY PROHIBITED. Searches may be undertaken upon entry and re-admittance to ensure compliance with the provisions of these Conditions. Any alcohol above the permitted allowance may be confiscated.
10. Boutique Camping
10.1 All standard camping terms and conditions are applicable in addition to the specific terms outlined in this section.
10.2 All Boutique Camping accommodation is as per description at the time of booking, but this does not mitigate our right to amend any errors in pricing or description.
10.3 Prices are based on per Boutique Camping accommodation type as noted. Unless otherwise stated no catering is provided for any group or individual booking any accommodation type in the Boutique Camping area.
10.4 You undertake to keep any part of the Boutique Camping accommodation that is a tent completely closed and secure and in particular any door fastened when not in use
10.5 You undertake not to use any lighting, heating, cooking or other gas or electrical appliances within the confines of the Boutique Camping accommodation, unless such items are included in your booking and provided by the Event Organiser.
10.6 You undertake not to light, or allow to be lit, any fire, candle or other naked flame within or close to the Boutique Camping accommodation.
10.7 You undertake not to tamper with the structure or any part of the Boutique Camping accommodation and in particular not to affix or suspend from the Boutique Camping accommodation any item.
10.8 You shall throughout the period of hire be responsible for the maintenance and safe custody of the Boutique Camping accommodation.
10.9 You must be satisfied with the Boutique Camping accommodation before use and should notify event staff of any unacceptable Boutique Camping accommodation before use.
10.10 You shall indemnify the Event Organiser against the full value of any loss damage or excessive soiling howsoever caused, unless caused by negligence by the Event Organiser, its contractors or agents.
10.11 The price of the Boutique Camping accommodation does not include making good any repairs to the Boutique Camping accommodation unless caused by the negligence of the Event Organiser’s staff, agents or contractors.
10.12 The Event Organiser’s Boutique Camping provider is Tangerine Fields, who will make every effort to complete the erection of the Boutique Camping accommodation on or before the commencement of the Eroica Britannia. If the Boutique Camping accommodation is not erected on or before this date, you shall have the right to withdraw and we shall return all monies paid. If the Boutique Camping accommodation is not erected because of delays due to weather or other circumstances beyond its reasonable control the Event Organiser shall not be liable to pay further compensation to you.
10.13 The Event Organiser will not be responsible for and you will indemnify them against all claims for the injury to persons or loss or damage to property howsoever caused unless it be proved that such injury or damage was caused by faulty material or workmanship or negligence on the part of the Event Organiser, its contractors or agents.
10.14 You are permitted to bring your own food and soft drinks for your own consumption in the campsites but not for resale. No glass is permitted on site. In addition, you are only permitted to bring either 12 x 300ml cans of beer/lager and/or cider per person OR 6 x 300ml cans of beer/lager and/or cider per person and 1 75cl bottle of wine (which must be decanted into a plastic bottle) per person. Such items may only be brought into the site on first entry. ALCOHOLIC SPIRITS ARE STRICTLY PROHIBITED. GLASS BOTTLES ARE STRICTLY PROHIBITED. Searches may be undertaken upon entry and re-admittance to ensure compliance with the provisions of these Conditions. Any alcohol above the permitted allowance may be confiscated
11. Withdrawal, Cancellations or Alterations
11.1 The Participant will not receive a full or partial refund of entry Fee should the Event be cancelled at any point. No further liability of the Event Organiser whatsoever stands arising from such cancellation.
11.2 The Participant acknowledges that places on the Event are limited and payment of the Fee and reservation of the place has an effect on logistics and the subscription for the Event. Accordingly, any Participant withdrawing from the Event from June 1st 2018 onwards shall not be entitled to a full or partial refund of any purchased tickets. Participants requesting a refund of entry fee/s up until midnight May 31st 2018 will incur an administration fee of 25% of the total value of the tickets being refunded.
11.3 Tickets purchased for the Classic Ride are non-transferable to the Nova Ride and vice versa.
12. Limitation of Liability
12.1 The Event Organiser excludes all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law.
12.2 Nothing in these Conditions shall exclude or limit the liability of the Event Organiser:
12.2.1 for death or personal injury caused by the Event Organiser’s negligence;
12.2.2 for fraud or fraudulent misrepresentation; or
12.2.3 for any other liability which cannot be restricted by law.
12.3 Subject to clause 6.2 the Event Organiser shall under no circumstances whatsoever be liable to the Participant whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Event.
12.4 The Event Organiser shall not be liable for any actions of any spectators or other third parties.
13. Publicity & Results
13.1 The Participant consents to the Event Organiser taking photographs or video footage at the Event. Photographs and video footage will be used by the Event Organiser for promotional purposes and may include printed documents or media, editorial coverage, advertising press and use on the internet. Participants who do not wish for their images to be used in such ways must inform the Event Organiser prior to the Event, in writing via email to email@example.com.
13.2 Any film, photographs (by camera or mobile phone), or any other recording of moving or still picture, and all intellectual property in connection therewith (including but not limited to copyright) shall remain the property of the Event Organiser, and where such intellectual property does not automatically vest in the Event Organiser, these Conditions shall constitute a legally binding assignment thereof and/or the Participant shall sign all reasonable documentation required to give affect thereto.
13.3 The Event is not being timed and the Event Organiser will not be providing an Event finish time for the Participant.
14.1 All Participant information shall be processed in accordance with the Data Protection Act 1998.
14.2 These Conditions (and the documents referred to in them) constitute the entire agreement and understanding of the Parties and supersede any previous agreement between the Parties relating to the Event.
14.3 Nothing in these Conditions shall constitute or be deemed to constitute a partnership between the Parties hereto or constitute or be deemed to constitute either Party as agent of the other for any purpose whatsoever and neither Party shall have authority or power to bind the other or to contract in the name of the other in any way or for any purpose.
14.4 No waiver by either Party of a breach or a default hereunder shall be effective unless in writing and signed by both Parties and any such waiver shall not be deemed to be a waiver of any subsequent breach or default of the same or similar nature.
14.5 To the extent permitted by law all provisions of these Conditions shall be severable and no provision shall be affected by the invalidity or unenforceability of any other provision.
14.6 The Event Organiser reserves the right to amend these Conditions and the Ride Day Rules from time to time.
14.7 These Conditions shall be interpreted in accordance with the laws of England and Wales and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the English Courts.
15. Competitions & Offers
15.1 All Eroica Britannia competitions or offers are open to residents of the UK aged 18 and over. Entry into any competitions or offers will be deemed as acceptance of these Terms and Conditions.
15.2 To enter any competitions or offers you must follow the online/email/direct mail instructions and submit your entry via the Eroica Britannia website unless otherwise stated. If you have any questions about how to enter, or in connection with any Competitions or offers, please e-mail firstname.lastname@example.org with ’competition/offer enquiry’ in the subject line.
15.3 Only one entry per person is permitted to any competition, unless otherwise stated.
15.4 All prizes are non-exchangeable, non-transferable, and can not be redeemable for cash or other prizes.
15.5 The Event Organiser retains the right to substitute the competitions or offers with other prizes of similar value in the event the original prize offered is not available.
15.6 The winners may be required for promotional activity.
15.7 No purchase necessary, unless otherwise stated.
15.8 Nothing in these Terms & Conditions shall exclude the liability of the Event Organiser for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
15.9 The Event Organise accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the competition or accepting the prize. The Event Organise further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the competition.
15.10 The Event Organise shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
